General Conditions of Sale (THE SERENE MAMMA)

Article 1: Scope of Application

These general conditions of sale apply to all transactions concluded through the websites of the THE SERENE MAMMA network. A "client" is any natural or legal person placing an order with THE SERENE MAMMA that is validated via our secure payment platform.

Article 1a: Age Limit

Age restrictions apply: THE SERENE MAMMA only accepts clients over 18 years old for any digital products, coaching, workshops, or seminars. We strive to restrict access to our sites, products, and services to minors. Although the content of our products and services is appropriate for a mature audience, any subscriber found to be under 18 will be removed from our database immediately. Similarly, any order placed by a client not meeting the age requirement will be cancelled, and any associated payment refunded.

Article 2: Orders

Placing an order on a site operated by THE SERENE MAMMA implies full and unconditional acceptance of these general conditions of sale. Orders for digital products are final and non-refundable after delivery.

Article 3: Prices

Prices are indicated in South African Rand (ZAR) or U.S. Dollar (USD), including all applicable taxes as per South African VAT regulations. Prices for products can change at any time, but the price applied will be the one displayed at the time of the order.

Article 4: Payment

Payment is due immediately upon placing an order, including for pre-order products. Payment can be made by credit card or other approved methods. We use a secure online payment system for credit card payments. The transmission of payment data is encrypted and secured through industry-standard software. Any assurance regarding the security of the payment system is the responsibility of the payment service provider and cannot be attributed to us.

Article 5: Delivery

Delivery of digital products is performed via electronic means to the email address provided during the order process. It is the client’s responsibility to ensure that the email address provided is accurate. THE SERENE MAMMA will not be liable for any failed delivery due to incorrect or incomplete information provided by the client. Once the product is electronically delivered, the risk of loss or damage shifts to the client.

Article 6: Protection of Personal Data

In compliance with the Protection of Personal Information Act (POPIA), you have the right to access, correct, or request the deletion of personal data collected by us. By agreeing to these general conditions of sale, you consent to the collection and use of your personal data as outlined in our privacy policy. By entering your email address on any site operated by THE SERENE MAMMA, you agree to receive emails containing information and promotional offers from THE SERENE MAMMA and its partners. You can unsubscribe at any time by clicking the “Unsubscribe” link provided in each email.

Article 7: Refund Policy

Due to the nature of digital products, all sales are final. Once the product has been delivered, no refunds will be issued. Exceptions may only be made where mandated by South African consumer protection laws, such as cases of defective products or non-compliance with the description.

Article 8: Applicable Law

These general conditions of sale, as well as all transactions referred to herein, are governed by the laws of the Republic of South Africa. Any disputes arising from these terms will be resolved in South African courts.
